Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("User", "you") and WTF ("we", "us", "our"), operator of im.wtf (the "Service"). By creating an account, accessing, or otherwise using the Service, you agree to these Terms in full. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms. Where you act on behalf of an entity, you warrant that you are authorised to bind that entity.
2. The Service — "as is"
The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted operation, and freedom from defects, viruses, or errors.
We may modify, suspend, throttle, or discontinue any part of the Service at any time, with or without notice, without liability to you or any third party.
3. User accounts
You are solely responsible for safeguarding your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use. We may refuse, suspend, terminate, reclaim, or rename any account or username at our sole discretion, including without limitation for inactivity, impersonation, trademark conflict, abuse, or violation of these Terms.
4. User content & licence to us
You retain ownership of the content you submit, post, or display on the Service ("User Content"). You grant us a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to host, store, reproduce, modify (for technical purposes such as resizing), publish, publicly display, transmit, and distribute your User Content for the purposes of operating, providing, promoting, and improving the Service. This licence survives termination only to the extent reasonably necessary for backups, legal compliance, and aggregated analytics.
You represent and warrant that (a) you own or have all necessary rights, licences, consents, and permissions for your User Content, (b) your User Content does not infringe any third-party rights including intellectual property, privacy, or publicity rights, and (c) your use of the Service complies with all applicable laws.
5. Prohibited content & conduct
You agree not to upload, post, link to, or promote content that:
- Infringes any copyright, trademark, patent, trade secret, or other intellectual property right;
- Is unlawful, defamatory, fraudulent, threatening, harassing, hateful, or discriminatory;
- Contains child sexual abuse material (CSAM) or sexualises minors in any way;
- Promotes terrorism, violent extremism, or self-harm;
- Contains malware, phishing payloads, or attempts to compromise security;
- Violates the privacy or publicity rights of any person;
- Constitutes spam, scams, pyramid schemes, or undisclosed paid promotion;
- Violates any applicable law of Ireland, the European Union, or any jurisdiction from which the content is uploaded or accessed.
You further agree not to (i) reverse-engineer, scrape at scale, or interfere with the Service, (ii) circumvent rate limits or access controls, (iii) use the Service to train machine-learning models without our prior written consent, or (iv) use any automated means to create accounts.
6. Hosting provider status & safe harbour
We act as a neutral hosting provider for User Content within the meaning of Articles 4 and 6 of Regulation (EU) 2022/2065 (Digital Services Act) and Article 14 of Directive 2000/31/EC (E-Commerce Directive). We do not pre-screen User Content and have no general obligation to monitor it. We are not the author of User Content and expressly disclaim all liability arising from it.
7. Notice & takedown / DMCA
If you believe content on the Service infringes your intellectual property rights or is otherwise illegal, send a notice to arewewtf@gmail.com including:
- Your full legal name, postal address, and contact details;
- Identification of the work or right alleged to be infringed;
- The exact URL(s) of the allegedly infringing content;
- A statement, made under penalty of perjury, that you are the rights-holder or authorised to act on their behalf, and that the use is not authorised;
- An electronic or physical signature.
We will review valid notices and may remove or disable access to content without prior notice. We reserve the right to require legal verification, to forward the notice to the affected user, and to terminate accounts of repeat infringers. Knowingly false notices may result in liability for damages including legal costs.
8. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall WTF, its affiliates, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with the Service, even if advised of the possibility of such damages.
Our aggregate liability to you for all claims in any twelve-month period shall not exceed the greater of (a) the total fees you actually paid us for the Service during that period, or (b) one hundred euros (€100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law (such as gross negligence, wilful misconduct, or liability for death or personal injury caused by negligence).
9. Indemnification
You agree to defend, indemnify, and hold harmless WTF, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your User Content; (b) your use of or access to the Service; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual property, privacy, or publicity right.
10. Suspension & termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, and without liability. You may terminate your account at any time by deleting it. Sections that by their nature should survive termination (including 4 last sentence, 5, 7, 8, 9, 11, 12, 13, 14) shall survive.
11. Governing law & jurisdiction
These Terms are governed by the laws of the Republic of Ireland, without regard to its conflict-of-laws principles. The courts of Ireland shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, and you irrevocably submit to that jurisdiction. Mandatory consumer-protection rights of consumers domiciled in the EU remain unaffected.
12. No class actions
To the extent permitted by law, you agree to bring any claim against us solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
13. Severability & waiver
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect. Failure to enforce any right or provision shall not constitute a waiver of that right or provision.
14. Entire agreement & changes
These Terms, together with our Privacy Policy and Imprint, constitute the entire agreement between you and us regarding the Service. We may update these Terms from time to time; material changes will be announced via the Service. Continued use after a change constitutes acceptance.
